PRIVACY POLICY

This Privacy Policy describes how Cascade Public Media (“Cascade PBS” or “we” or “our” or “us”) treats certain information collected or provided in connection with an end user’s (“you” or “your” or “user”) use of Cascade PBS’s websites, www.cascadepbs.org, www.cascadepublicmedia.org, and any other website, social media pages, apps, or other digital medium owned or operated by Cascade PBS (or related companies) (collectively, the “Site”). This Privacy Policy also applies to any Personal Information (defined below) collected, stored, or used by us in connection with the Services (as defined in our Terms of Use).

The information provided in this Privacy Policy is designed to inform you of the categories of Personal Information we collect and the sources from which we obtain it; how and why we use your Personal Information; when and with whom we share or disclose your Personal Information; how we use cookies, pixels, and similar technology; how we retain, secure, and protect your Personal Information; your privacy rights and choices, including how to access, correct, delete, or port your data (as applicable) and how to opt out of certain collection; and how to contact us with questions or requests. By accessing or using our Site, you acknowledge and consent to the Terms of Use and acknowledge this Privacy Policy, including our collection, use, and disclosure of your Personal Information, as described below. This Privacy Policy is not a contract and does not create any legal rights.

Definition of Personal Information

“Personal Information” is any information that can be used to identify you, but does not include, for example, information lawfully made available from federal, state, and local government records, information lawfully made available to the general public by the consumer or from widely distributed media, and information made available by a person to whom the consumer has disclosed the information if the consumer has not restricted the information to a specific audience.

This Privacy Policy does not cover data we, or our authorized third-party vendors or partners, collect lawfully, information that does not or cannot be used to identify a particular individual, or de-identified, aggregate, or pseudonymous data.

Sensitive Personal Information

We may collect or process “sensitive personal information” (as defined under applicable state privacy laws), in connection with job applicants, which may include details such as Social Security number or government-issued identification numbers, financial account or payment card information with access credentials, health information or medical conditions, immigration or citizenship status, contents of communications (unless we are the intended recipient), or similar information. We will not process sensitive personal information except where: (a) you have provided specific, opt-in consent; (b) such processing is strictly necessary to provide or maintain a product or service you have specifically requested; or (c) as otherwise permitted under applicable law. We will not use or disclose sensitive personal information for targeted advertising purposes.

Sources of Personal Information, Generally

We get most Personal Information directly from you, through the Site, or from transactions with you in connection with our Services. We might also obtain Personal Information about you from other Site users or other entities with whom we have contact. For example, we may obtain information through public records, or transactions you have with our authorized third-party vendors or partners, some of which may be deemed Personal Information. If you are sharing information with us about any other individual, you must obtain their consent.

Categories of Personal Information Collected

The categories of Personal Information we may collect from you include:

Information Collected Automatically

We may automatically receive and store certain types of Personal Information whenever you visit the Site, such as information from Google Analytics (see https://policies.google.com/privacy) on when, how often, and for how long you use the Site, information related to your geographic location, and the content you submit and view. This information may include the name of the domain and host from which you access the Internet and the IP address of the computer or device you are using. We may log and use your IP address to administer the Site, to help diagnose problems with our server, to analyze trends, to track users’ webpage movements, to help identify you and/or verify your use, and to gather broad demographic information for aggregate use. We may use standard tools, such as cookies or web beacons, to monitor the Site and Internet usage and to improve or customize the content on the Site. You should be able to control the use of cookies with respect to your own devices by changing your own browser settings.

Information from Other Sources

Cascade PBS Passport Service: If you are viewing on-demand video on Cascade PBS’s websites via the Cascade PBS Passport service or player, you have agreed that PBS may collect your viewing and usage information and that PBS may share this information with Cascade PBS. Your individual and usage viewing information will only be shared with Cascade PBS, but PBS may share anonymized aggregate viewing and usage information with its member stations and service providers, as well as Cascade PBS. PBS’s collection, storage, and use of Passport information is subject to PBS’s Terms of use and Conditions and PBS’s Privacy Policy.

Cookies, Pixels, Tags, and Advertising Technologies

Our website and emails use cookies, web beacons, pixels, local storage, tags, and similar technologies (collectively, “Tracking Technologies”) to understand how you interact with our content and to deliver and measure advertising. These Tracking Technologies may be provided by us or by third parties, including social media and digital advertising partners such as Meta, Google, LinkedIn, and other advertising and/or analytics providers. When these Tracking Technologies load, they may allow those companies to collect or receive information from our website and other online services (such as your IP address, browser details, pages viewed, queries made, and actions taken) and use that information to provide measurement services and target ads. Log Data

Our web servers may collect log data, which provides aggregate and/or non-aggregate information about the number of visits to different pages on the Site. We use such log data to improve access to the Site based on visitors’ web browsers and operating system types to make the Site available to as many users as possible. We do not link the log data collected to Personal Information except as necessary to provide and/or manage our Services. Third party providers may also collect log data independently from us.

Our Usage of Tracking Technologies

What are Tracking Technologies? Tracking Technologies (such as cookies, pixels, and web beacons) are small text files that can be used by websites to make a user’s experience more efficient. They serve a range of purposes, including enabling core site functionality, remembering your preferences, analyzing site performance, and delivering targeted promotion. Tracking Technologies such as cookies may be served by the entity that operates the website you are visiting (“first-party cookies”) or by other companies (“third-party cookies”). Our Site may integrate third-party analytics cookies, like Google Analytics, to help us understand how you are using our Site so that we can make improvements. We may also use other technologies that function similarly to cookies. For instance, we may use web beacons (also called pixels), which are small images on a web page or in an email. Web beacons collect information about your browser or device and can set cookies. In addition, we may use local storage, which allows data to be stored locally on your browser or device.

How do we use Tracking Technologies? This website uses cookies and similar tracking technology, and provides users with options to accept, reject, or modify such use. Some cookies are placed by third party services that appear on our pages. We use Tracking Technologies to provide core site functionality, personalize your experience across our Site, provide social media features, analyze our traffic, and refine our offerings. We also share information about your use of our Site with our social media, advertising, and analytics partners who may combine it with other information that you’ve provided to them or that they’ve collected from your use of their services. This sharing may constitute a “sale” or “sharing” of personal information under applicable law, and you may have the right to opt out. Tracking Technologies generally fall into one or more of the following categories:

Website Interaction Tracking. We may use session replay tools, chat analytics, search analytics, and heat-mapping tools on certain pages of our Site to understand how users interact with our services, diagnose technical issues, and improve functionality. These tools may capture mouse movements, clicks, scrolling behavior, text entered into search fields or chat windows, and page navigation patterns.

Use, Retention, and Sharing. This Site uses several categories of Tracking Technologies. Some Tracking Technologies are placed by third party services that appear on our pages. Under applicable data protection laws, we may store strictly necessary Tracking Technologies on your device without your consent, as they are essential for the operation of this site. For all other Tracking Technologies (including those used for preferences, statistics, marketing) we typically require your consent before they are activated. The data collected through tracking tools is retained for a reasonable period necessary to fulfill our business and analytical purposes. We do not sell or use this data for advertising or profiling purposes. We may share information about your use of our site with trusted third-party partners, such as analytics providers, who assist us in understanding site usage and improving our services. Where such sharing constitutes a “sale” or “sharing” of personal information under applicable law, you may have the right to opt out. We provide notice of these tools through a cookie banner and, as applicable, offer you the ability to opt out.

What are your choices concerning Tracking Technologies? You have the right to choose whether or not to accept most Tracking Technologies. However, since Tracking Technologies can be an important part of how our Services work, if you remove or reject cookies, this could affect the availability and functionality of our Services. We recognize and honor automated opt-out preference signals, including Global Privacy Control (“GPC”) and other legally recognized Universal Opt-Out Mechanism (“UOOM”) signals, as required by applicable law. You can also change or withdraw your consent at any time via our Site. Once you have selected a consent level you can click on the Your Privacy Settings link in the bottom right of the footer of our Site and  can review, modify, or withdraw your Tracking Technologies consent preferences for our Site at any time. Here are some options to control or limit how Tracking Technologies are used on our Services:

Data Minimization

Data Minimization and Protection Assessments. We collect and process personal information only to the extent that it is reasonably necessary and proportionate to the purposes for which it was collected, as described in this Privacy Policy. We periodically review our data collection and processing activities to ensure they remain aligned with applicable data minimization requirements under state, federal, and international privacy laws.

Sensitive Field Masking

Sensitive input fields—such as those for passwords and payment card numbers—are masked and are not recorded or transmitted to any third party.

General Reasons for Collection and Use

We collect Personal Information to help identify you; to perform contractual obligations, including our Services and/or processing and fulfillment of orders; to communicate with you; to properly administer our Site and to maintain records; to research and analyze the use of our Site and Services so we can improve our Services; to detect and prevent fraud; to exercise and defend legal claims; to comply with legal obligations; and for other purposes as described in this Privacy Policy. This information may be shared with third parties, such as our advertising partners, to show you ads on other websites that match your interests. Protected classification characteristics such as age and gender are not collected intentionally but may be revealed in identity and/or employment data or other information we collect and subsequently store in our systems.

Accounts, Profiles, and Preferences

Account Registration. For some aspects of our Site, you may need to or be able to register an account with us via our Site (“Account”) by providing certain Personal Information. In doing so, or in connection with our Services generally, you may need to represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use the Site. You may also need to provide a valid email address or add shipping and billing information to place orders. All information that you provide to Cascade PBS or its vendors, agents, associates, or partners, including your payment card or financial account information, is subject to Cascade PBS’s Privacy Policy or the respective third-party privacy policy. You may be able to update, correct, or delete information about you by logging into your Account and updating your profile information or by emailing us at customerservice@cascadepbs.org. If you wish to delete your Account or, under appropriate circumstances, any Personal Information that may have been collected, please email us at customerservice@cascadepbs.org, but note that we may require further confirmation procedures and necessarily retain certain information about you for legitimate business purposes or as required by law.

Personal Profiles and Preferences. We may also collect and maintain Personal Information about you to create a personal profile containing preferences and other information that you voluntarily provide to us. This information is used for improved functionality of and your interaction with our Services and not for third-party commercial advertising purposes. Examples of the types of information we may collect for this purpose include your first and last name, a valid email address, and geographic location or address. Additionally, we may use your email address to send confirmation of purchases and, if necessary, to contact you to help process a purchase. We may also use your email address to notify you about special offers, promotions, upcoming events, or matters that may be of interest to you.

 

Cross-Context Behavioral Advertising

Cross-context behavioral advertising is a type of targeted advertising that collects and uses data about your activity on websites, apps, or services that are not affiliated with us. This information is used to deliver tailored ads to you across one or more of these sites. If you do not want us to share your Personal Information for such cross-context behavioral advertising purposes, depending on your location, you can opt out by clicking the “Your Privacy Settings” link  at the bottom right  footer of our Site to directly adjust your cookie and tracking preferences, or by emailing us at customerservice@cascadepbs.org. You can learn more about opting out of personalized advertising in web browsers by visiting the Digital Advertising Alliance’s consumer resources page at https://youradchoices.com/.

Opt-Out Options

Consent and Opt-Out for Tracking Technologies. Where required by law, we will obtain your consent before using these technologies, and you can withdraw your consent or change your preferences at any time through your browser settings. Depending on your location, you may also have the right to opt out of ‘sale’ or ‘sharing’ of Personal Information for cross context behavioral advertising.

GPC / UOOM. We recognize and honor automated opt-out preference signals, including Global Privacy Control (“GPC”) and other legally recognized Universal Opt-Out Mechanism (“UOOM”) signals, as required by applicable law. When our systems detect a valid GPC or UOOM signal from your browser or device, we treat it as a valid request to opt out of: (a) the “sale” of your personal information; (b) the “sharing” of your personal information for cross-context behavioral advertising; (c) targeted advertising; (d) profiling in furtherance of decisions that produce legal or similarly significant effects (as those terms are defined under applicable federal privacy laws). This opt-out will be applied to the browser or device sending the signal and, where technically feasible, will be extended to your authenticated account profile, associated identifiers such as cookies and device IDs, and downstream data-sharing partners and vendors. We do require you to take additional steps to exercise your opt-out rights when using GPC. If you wish to extend your opt-out to additional devices or browsers, you may contact us at customerservice@cascadepbs.org to submit a request that applies across your account. Categories of Personal Information Disclosed or Sold

Our Sale and Sharing Practices. Information lawfully made available from federal, state, and local government records, information lawfully made available to the general public by the consumer or from widely distributed media, and information made available by a person to whom the consumer has disclosed the information if the consumer has not restricted the information to a specific audience, as well as data we, or our authorized third-party vendors or partners, collect that cannot be used to identify an individual, and deidentified, aggregate, or pseudonymous data is information that is collected, refined, and/or sold by Cascade PBS in accordance with relevant US law. Nevertheless, we do not sell Personal Information to any third parties.

Third Parties with Whom We Share Personal Information. In order to conduct our business and better serve you, we may disclose Personal Information and other information about you or your activities on our Site or while using our Services with:

Categories of Personal Information We May Share. The type of Personal Information we may share with others may include (a) your name and contact information, including your phone number, email address, and mailing address; (b) your payment card number (or other payment method) and related validation information; (c) information you provide when interacting with the Site; (d) website analytics information, including when, how often, and for how long you use the Site; information related to your geographic location; the content you submit and view; the name of the domain and host from which you access the Internet; and the IP address of the computer or device you are using; and (e) other identifiable information about you, such as date of birth, gender, age, and photographic images of you, including for purchases, exhibitions, commissions, or sweepstakes/contest entrants and/or winners.

Third-Party Independent Collection. Some third-party providers may independently collect Personal Information when you visit our Site. Our authorized third-party vendors and partners have their own privacy policies which govern the use, handling, and disclosure of your Personal Information.

Third-Party Analytics Services. We also may use third-party web analytics services on our Site, such as those of Google Analytics (see https://policies.google.com/privacy). The information collected may be used by Cascade PBS and/or others in aggregated / anonymized formats to, among other things, evaluate use of the Site and relevant Services, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on our Services and other websites, and better understand your online activity. Marketing Correspondence and Advertising Partners

Email Marketing and Pixel Tracking. We may use third-party service providers or content to send or augment our marketing correspondence. To that end, we collect a variety of information about how users interact with our marketing efforts, including how many times an email is opened and/or clicked, the browser type used, operating system, user email program, etc. In addition, third parties that may assist with our marketing correspondence may use pixel tags that help us send the message in a format you can read, allow us to know which correspondence you act on, and to better target the content of future correspondence. We also use these tags to track the aggregate number of emails read and whether any of the links in the email were accessed.

Digital Advertising Networks and Targeted Advertising. Through our participation in digital advertising networks and in connection with select third parties, we may share for targeted advertising the following categories of personal information for our own use: identifiers; characteristics of protected classifications under California and federal law; internet/electronic activity; commercial information; and inferences drawn from the categories described above in order to create a profile about you to reflect your preferences, characteristics, behavior and attitudes. We do not knowingly sell or share/use for targeted advertising the personal information of minors under the age of thirteen (13).

SMS/Text Message Privacy. If you opt in to receive text messages from us, your use of the text messaging program and the information you provide in connection therewith, including your mobile phone number, is subject to this Privacy Policy. We will not sell, rent, or share your mobile phone number or SMS opt-in data or consent with any third parties or affiliates for their own marketing purposes.

Payment Processors

Payment processing via our Services is provided directly by us or by one or more third party payment processors as we may designate from time to time (“Payment Processor”). Cascade PBS currently accepts payments via several Payment Processors, including Square (https://squareup.com/us/en/legal/general/privacy-no-account), Stripe (https://stripe.com/privacy), Clover (https://clover.com/privacy-policy), and WorldPay (https://privacy.worldpay.com/policies). Cascade PBS does not collect or store your payment card information. Your payment transaction data is stored only as long as is necessary to complete your transaction. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. For additional information, you can find out more about our Payment Processors’ privacy practices by visiting the websites of the applicable Payment Processor during a transaction. We are not responsible for our Payment Processors’ services, privacy policies, cookie policies, or data processing agreements and you assume all related risks when interacting with such.

Retention, Confidentiality, and Security of Personal Information

Retention Periods and Criteria. We retain Personal Information for as long as is reasonably necessary for our business operations and to fulfill the purpose of collection or further processing as described in this Privacy Policy; as we determine is necessary for business records; and to comply with applicable law. In deciding how long to retain Personal Information, we consider many criteria, including the business purposes for which the Personal Information was collected, relevant federal, state, and local recordkeeping and personal data privacy laws, applicable statutes of limitations for lawsuits, claims or disputes to which the Personal Information may be relevant, and legal preservation of evidence obligations. Some Personal Information is deleted automatically after a set period of time, often set by law, unless we are legally required to hold it longer, such as for pending litigation. If you would like to receive any further information about our data retention periods, please contact us using the contact details in the Contact Us section below.

Security Measures and Breach Notification. We restrict access to Personal Information to those who need to know in order to provide services to you and to conduct our internal operations. We maintain reasonable physical, electronic, and procedural safeguards to guard your information. However, the Internet and digital information is not absolutely secure and, thus, we cannot promise guaranteed security. In the unlikely event that we believe that the security of your Personal Information in our possession or control may have been compromised, we may seek to notify you. As applicable, we will comply with notification requirements for a security breach and may also notify you using the email address you have provided to us.

NO WARRANTY. We make no warranty—express, implied, or otherwise—that we will prevent unauthorized access to or use of your Personal Information. If you do not agree to the collection, processing, storage, and transfer of your Personal Information, please do not provide your Personal Information or use our Services.

Business Transfers. In the event of a merger, acquisition, corporate change, or bankruptcy, we may share, sell, or transfer your Personal Information as part of a transfer of our assets to the acquiring entity.

Children / Minors

Target Audience. This Site and our Services are not directed at children under the age of 18. We do not knowingly collect personal information (as defined under the Children’s Online Privacy Protection Act (“COPPA”) and applicable state and international laws) from children under 13. If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will work to remove that information promptly.

Communications Compliance

Applicable Laws. We comply with all applicable federal and state telemarketing and consumer protection laws.

Do-Not-Call / Third-Party Communication Vendors. When we use third-party service providers to send mobile notifications on our behalf, we require those providers to maintain TCPA-compliant programs, promptly process opt-out and revocation requests across all campaigns, and comply with all applicable federal and state telemarketing regulations. We regularly update our own records against our vendor’s opt-out lists.

Your Rights

Under state or international law, you may have certain rights. Please read below for information or options that may apply to residents of certain jurisdictions.

How to Exercise Your Rights; Verification Process. To exercise any of the rights described in this section (regardless of your jurisdiction), you or your authorized agent may submit a request by contacting us at customerservice@cascadepbs.org or Cascade Public Media, address: 316 Broadway, Seattle, WA 98122; phone: 1-800-937-5287. We will verify your identity before processing your request by matching information you provide against information we maintain. You or your agent must provide sufficient confirmable identifying information for us to verify your request. In some states, you can designate an authorized agent to make a request on your behalf; if so, we may require written signed permission from you, proof of your identity, and verification of the agent’s identity. We will respond to verifiable requests within the timeframes required by applicable law. We will not discriminate against you for exercising any of your privacy rights. Please note that we are not required to respond to more than the legally permitted number of requests per calendar year, and certain information may be retained for recordkeeping, to complete transactions you began, or as required by law.

Users from California

As we do not sell your Personal Information, there is no need to submit a request to opt-out.

We will not disclose your Personal Information to third parties for them to use for their direct marketing purposes unless you agree to us making that disclosure.

“Do not track”: Section 22575 of the California Business & Professions Code requires website and online service operators to disclose whether they honor web browser “Do Not Track” settings. Some browsers incorporate a “Do Not Track” (DNT) feature that, when turned on, signals to websites and online services that you do not wish to be tracked. We work diligently to respond to clear browser DNT signals. We reserve the right to update our practices and Privacy Policy as such standards evolve. “Shine the Light” law: Effective January 1, 2005, under California Civil Code Section 1798.83, if an individual who is a California resident has provided Personal Information to a business in connection with a business relationship that is primarily for personal, family, or household purposes, and if that business has within the immediately preceding calendar year disclosed such an individual’s Personal Information to a third party and knows or should have known that such third party used the information for its own direct marketing purposes, then that business is obligated to disclose in writing to such individual upon request, what Personal Information was shared and with whom it was shared.

You or your agent must provide sufficient confirmable identifying information in order for us to verify your request.

You have the right to not be discriminated against for exercising any of these rights. Any request for a disclosure required under this California law should be sent to us as indicated below in the Contact Us section. Please note that under this law, we are not required to respond to your request more than once in a calendar year, nor are we required to respond to any request that is not sent to the email or mailing address as noted herein.

Users from Other US States / Summary of Multi-State Consumer Rights

If you are a resident of a US state that has applicable privacy laws, including but not limited to, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to obtain confirmation that we maintain certain Personal Information relating to you, to verify its content, origin, and accuracy, as well as the right to access your Personal Information, request updates or corrections to your Personal Information, request deletion or portability of your Personal Information. You may also have the right to obtain the identities of the third parties to whom we disclose your Personal Information. You may also request restriction of the processing, including for targeted advertising. Additionally, in certain states you may have the right to opt-out of the “sale” of your Personal Information, as the term is defined under applicable law.

Your rights may include: (a) the right to confirm whether we process your Personal Information and to access such data; (b) the right to correct inaccuracies in your Personal Information; (c) the right to request deletion of your Personal Information, subject to certain exceptions; (d) the right to obtain a copy of your Personal Information in a portable, machine-readable format (data portability); (e) the right to opt out of targeted advertising, the “sale” of your Personal Information, and profiling in furtherance of decisions that produce legal or similarly significant effects; (f) the right to appeal a denial of your privacy request; and (g) the right to not be discriminated or retaliated against for exercising any of these rights.

In some states, you can designate an authorized agent to make a request on your behalf. Please note that we may need to retain certain information for recordkeeping purposes, to complete any transactions that you began prior to your request, or for other purposes as required or permitted by applicable law. In any event, should you choose to exercise any of your rights as detailed above, we will not discriminate against you by offering you different pricing or products, or by providing you with a different level or quality of products, based solely upon this request.

Users Outside the United States

International Data Transfers. Our Site is hosted in the United States and our Services are governed by United States law. If you are using the Services from outside the United States, please be aware that your Personal Information may be transferred to, stored, and processed in the United States where our servers are located. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. By using the Services, you consent to your Personal Information being transferred to our facilities and/or to the facilities of those third parties with whom we share it as described in this Privacy Policy.

Legal Basis for Processing (European Economic Area [EEA], Switzerland, and the United Kingdom [UK]). As described in this Privacy Policy, we will only use (process) your Personal Information if you have given us consent to do so, it is necessary to fulfill a contract, or it is necessary for a legal obligation. When we transfer your personal information to other countries, we will protect that information as described in this Privacy Policy and in accordance with applicable law. Viewing and Amending Information

Opting Out of Communications. Opt-out requests may not be able to be immediately processed and we may continue to send you other types of transactional email communications.

Accessing, Amending, and Deleting Account Information. Users may be able to log into their Accounts to view, amend, or delete Account information, including Personal Information. Please note that while changes or deletions to an Account or Personal Information may be reflected promptly in the active user database, our servers or our associated third parties may retain previously provided information, and may be required to keep certain information or not delete it, or keep information for a certain period of time.

Limitations on Changes and Deletions. Any changes to, or deletion of, Account information does not affect any other information collected by us, or which we may retain and continue to use or disclose in accordance with this Privacy Policy.
